The legally-sanctioned destruction of reason?

Those who believed in work processes, it’s all about labor issues does not know what’s going on in German courtrooms so and what German companies now want to introduce even for special rights. Michael Gerber can sing that song and he just wanted to exercise his right to work, a constitutional law.

In Germany, the confidence in the judiciary was never very large. Judgments that do not understand a man like this happen often in the labor courts. Thus, the Federal Labor Court on 28 Ja-nu-ar 2010 — 2 AZR 764/08 handed down a verdict that should be read in conjunction with the change of prime minister of Baden-Württemberg to the EU.

„If an employee is not able to read work instructions, written in German, so may, after a recent ruling of the Federal Labor ordinary termination be justified. Abitur ohne Englisch?

In Deutschland war das Vertrauen in die Justiz noch nie sehr groß. Urteile, die kein Mensch versteht, sind gerade bei den Arbeitsgerichten üblich. So hat das Bundesarbeitsgericht am 28. Ja­nu­ar 2010 – 2 AZR 764/08 ein Urteil gefällt, das man im Zusammenhang mit dem Wechsel des Ministerpräsidenten von Baden-Württemberg zur EU lesen sollte.

„Ist ein Ar­beit­neh­mer nicht in der Lage, in deut­scher Spra­che ab­ge­fass­te Ar­beits­an­wei­sun­gen zu lesen, so kann nach einem ak­tu­el­len Ur­teil des Bun­des­ar­beits­ge­richts eine or­dent­li­che Kün­di­gung ge­recht­fer­tigt sein. Es stellt, so das Bun­des­ar­beits­ge­richt, keine nach § 3 Abs. 2 AGG ver­bo­te­ne mit­tel­ba­re Be­nach­tei­li­gung wegen der eth­ni­schen Her­kunft dar, wenn der Ar­beit­ge­ber von sei­nen Ar­beit­neh­mern die Kennt­nis der deut­schen Schrift­spra­che ver­langt, so­weit sie für deren Tä­tig­keit er­for­der­lich ist“.(1)

„In dem jetzt vom Bun­de­ar­beits­ge­richt ent­schie­de­nen Rechts­streit war der 1948 ge­bo­re­ne Klä­ger seit 1978 als Pro­duk­ti­ons­hel­fer bei der Ar­beit­ge­be­rin be­schäf­tigt, einem Un­ter­neh­men der Au­to­mo­bil­zu­lie­fe­rer­in­dus­trie mit ca. 300 Ar­beit­neh­mern. Er ist in Spa­ni­en ge­bo­ren und dort zur Schu­le ge­gan­gen. Nach einer vom Klä­ger un­ter­zeich­ne­ten Stel­len­be­schrei­bung aus dem Jahr 2001 zähl­te zu den An­for­de­run­gen die Kennt­nis der deut­schen Spra­che in Wort und Schrift. Im Sep­tem­ber 2003 ab­sol­vier­te der Klä­ger auf Kos­ten der Ar­beit­ge­be­rin wäh­rend der Ar­beits­zeit einen Deutsch­kurs. Meh­re­re ihm emp­foh­le­ne Fol­ge­kur­se lehn­te er ab.

Seit März 2004 ist die Ar­beit­ge­be­rin nach den ent­spre­chen­den Qua­li­täts­nor­men zer­ti­fi­ziert. In der Fol­ge­zeit wurde bei meh­re­ren in­ter­nen Au­dits fest­ge­stellt, dass der Klä­ger Ar­beits­an­wei­sun­gen und Prüf­an­wei­sun­gen nicht lesen konn­te. Im Sep­tem­ber 2005 for­der­te die Ar­beit­ge­be­rin ihn auf, Maß­nah­men zur Ver­bes­se­rung sei­ner Deutsch­kennt­nis­se zu er­grei­fen. Eine wei­te­re Auf­for­de­rung im Fe­bru­ar 2006 ver­band die Ar­beit­ge­be­rin mit dem Hin­weis, er müsse mit einer Kün­di­gung rech­nen, wenn er die Kennt­nis­se nicht nach­wei­sen könne. Nach einem Audit von April 2007 war der Klä­ger wei­ter­hin nicht in der Lage, die Vor­ga­ben ein­zu­hal­ten. Dar­auf­hin kün­dig­te die Ar­beit­ge­be­rin das Ar­beits­ver­hält­nis mit Zu­stim­mung des Be­triebs­rats zum 31. De­zember 2007.

Wäh­rend das zuvor mit dem Rechts­streit be­fass­te Lan­des­ar­beits­ge­richt Hamm hier­in noch eine ver­bo­te­ne mit­tel­ba­re Dis­kri­mi­nie­rung wegen der eth­ni­schen Her­kunft ge­se­hen und die Kün­di­gung für un­wirk­sam er­klärt hatte1, wies nun das Bun­des­ar­beits­ge­richt die Kün­di­gungs­schutz­kla­ge ab. Die Kün­di­gung ver­stößt, so das Bun­des­ar­beits­ge­richt, nicht gegen das Ver­bot mit­tel­ba­rer Dis­kri­mi­nie­rung wegen der eth­ni­schen Her­kunft“.(1)

Und hierin lag wohl der Fehler des Arbeitnehmers, dass er die weiteren Deutschkurse verweigert hat. Ottinger, der Abitur gemacht hat und dazu auch zwei Fremdsprachen schriftlich und mündlich nachweisen musste, was man nach seinem Debüt als Redner auf Englisch schon gar nicht versteht, verhält sich cleverer. Obwohl man schon fragen muss, wie er mit einem Englischkurs ein Sprachbild der unteren Ebene erreichen will, wenn bei ihm schon das Gymnasium versagt hat.

„Sobald ich meine Aufgaben als Ministerpräsident im Land ordentlich erledigt und übergeben habe, werde ich in Brüssel einen Sprachkurs machen, sagte der scheidende Ministerpräsident“ einem Pressevertreter. (2)

Die AMR versucht das Urteil des Bundesarbeitsgerichtes und LAG Hamm zu bekommen und wird es dann veröffentlichen. An alle Bewerber und Arbeitnehmer erstmal der Rat, verweigert keine Sprachkurse. Man kann nur hoffen, dass wegen diesem Urteil keine Kündigungswelle gegen ausländisch geborene Arbeitnehmer anrollt.
